The Supreme Court decided Thursday by a 5-3 vote that in effect granted al-Qaeda terrorists the same rights as American soldiers. (Chief JusticeRoberts recused himself because of a previous decision on the case while atthe appellate court level; Thursday's ruling overturned his decision.) JudgeClarence Thomas, reading a dissent from the bench for the first time in morethan 15 years on the Court, scathingly criticized the majority for adecision that he said would sorely hamper the president's ability toconfront and defeat a new and deadly enemy.
